CNS Neuro Rehab and Elderly Care Ltd. as a ‘data controller’ are committed to protecting your personal information and to being transparent about the information we hold about you.  

‘Personal information’ is any information about an individual from which they can be identified. 

This Privacy Notice explains what personal information we ‘process’ about you, how we use it and how long we will keep it for. In the context of the Data Protection (Jersey) Law 2018, ‘process’ means collecting, recording, storing, transferring and acting on information.

It is important that you read this privacy notice so that you fully understand how and why we are using your personal information. 

What type of information we have:

We currently collect and process the following information:

  • Identity information: Including your full name, title and date of birth.
  • Contact details: Including a billing address, an email address and a telephone number.
  • Health information: Including details about your medical history and current health condition. 
  • Primary carer/next of kin: Including their name and contact details.

How we get the information and why we have it:

Most of the information we process is provided to us directly by you or the person who referred you to our service. The information is necessary for us to develop your rehabilitation programme. 

Under the Data Protection (Jersey) Law 2018, the lawful bases we rely on for processing this information are:

  • We have your consent to do so: You are able to remove your consent at any time. You can do this by contacting us at info@cnsrehab.je or via phone on +44 (0)1534 528886 or +44 (0)7829 711207. However, withdrawing your consent may mean that we cannot continue to provide a rehabilitation service to you.
  • We have a contractual obligation to do so: The processing is necessary for us to fulfil our contract with you. 
  • We have a legal obligation to do so: The processing is necessary to comply with our professional standards of documentation. 

Data concerning health is considered ‘special category data’ under the Data Protection (Jersey) Law 2018. The lawful bases we rely on for processing this information are:

  • Medical purposes: Processing is necessary for medical purposes and is undertaken by a health professional. 

What we do with the information we have:

We use the information that you have given us in order to develop a bespoke plan for your rehabilitation. We also use the information to monitor your progress and the outcome of our interventions.

We may need to share this information with other healthcare or medical professionals in order to provide you with the best service. We will always ask for your consent before we do this. Any transfer of data between clinicians will use encrypted files with password protection. 

We also use your information for internal administrative purposes, for example, our accounting records, and to let you know about changes to our services or policies.

We use your next of kin details only in the event of an emergency, should we need to contact someone close to you.

We will never distribute your information to third parties unless we have your permission, or the law requires us to. We will never sell your personal information to other organisations.  

How we store your information:

Your information is securely stored using ‘Clinko’. This is a practice management software system, used worldwide in healthcare clinics. Your data is encrypted, transmitted and stored securely within the ‘Cliniko’ system. Records are password protected and can only be accessed by authorised staff within our team. 

At times, your therapist might need to keep duplicate paper copies of your clinical notes. Should this be necessary, these will be stored securely in a locked filing cabinet and shredded once they are no longer required (with originals being maintained within ‘Cliniko’). 

There is a statutory requirement for us to retain your information and any relevant treatment notes for a period of eight years. 

After a period of eight years from completing treatment, your records will be deleted from the ‘Cliniko’ system.

Your data protection rights:

Under data protection law, you have rights including:

  • Your right of access: You have the right to ask us for copies of your personal information. 
  • Your right to rectification: You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure: You have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing: You have the right to ask us to restrict the processing of your information in certain circumstances.
  • Your right to object to processing: You have the right to object to the processing of your personal data in certain circumstances.
  • Your right to data portability: You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have four weeks to respond to you.
